One of the most important aspects of Modelling is the understanding of Copyright. Models should be aware that under Australian, and many international, laws the creator/producer of the images, the Photographer, is normally the Copyright owner.
As a general rule of thumb, Models have no legal right to the images, but are protected to some extent by provisions of the Trade Practices Act.
- Copyright of images, by default, goes to the creator/producer, who is normally the Photographer
- Without written consent of the Copyright Owner, Models may not use, sell, edit or assign Copyright of the images
- Model Releases are used to assign Copyright, usually to the magazines for which shoots are conducted
- Models, in most cases, may use images from magazine Photoshoots for the purposes of self promotion in, for example, Model Portfolios. Models should, however, understand their legal rights of use prior to any such use
- Where official magazine Model Releases are used, Copyright is assigned to the magazine in question and all rights to the images, including publication in Australia and overseas, is at the discretion of the magazine
- In all cases of publication by the nude men's magazines, Models and Photographers receive payment as compensation for the assignment of Copyright
Important: Copyright ownership should not be taken lightly and any breaches of the Copyright Act could lead to criminal or civil law suits. These laws are meant to protect everyone, however the Copyright Owner is, ultimately, the person in the strongest position.
